Acceptable Use Policy (AUP): Hirely
This policy applies to every Customer, user, and Agent, in every business type and channel. If you break it, we may suspend Agents immediately (kill switch), remove content, terminate the account, and report unlawful activity. This policy governs how you use our Agents. It never limits your right to post an honest review or complaint about us (Terms of Service §19).
1. Spam, robocalling, and unwanted messaging
- No texts, calls, AI-voice calls, or prerecorded messages without the consent the law requires: prior express consent for informational messages, and prior express written consent for marketing (see sms-consent.md).
- No purchased, rented, scraped, or shared contact lists, and no "lead generator" consent you can't document.
- No messaging numbers on the National or internal Do-Not-Call lists without a valid exemption.
- Honor STOP and every reasonable opt-out request at once. Never disable opt-out handling, quiet hours (8am–8pm recipient local time), or frequency caps.
- No spoofed caller ID, no snowshoeing (rotating numbers to evade filters), no public URL shorteners, and no evading carrier filters.
- Email: follow CAN-SPAM (accurate headers, physical address, working unsubscribe) and mailbox-provider bulk-sender rules.
2. Deception and impersonation
- Never configure an Agent to deny being AI or to claim to be a human (ai-disclosure.md).
- No impersonating another person, business, government agency, or brand.
- No false or misleading claims in Agent messages about prices, availability, results, credentials, licenses, urgency, or scarcity. (This applies to messages your Agents send, not to your opinions or reviews of us.)
- No fake reviews, review gating, review incentives, or suppressing negative reviews (16 CFR Part 465). Never ask for Yelp reviews.
- No phishing, collecting credentials, or asking for card or bank details through Agents.
- No undisclosed endorsements or paid testimonials (FTC Endorsement Guides).
3. Illegal and prohibited goods and services
You may not use Agents to market, sell, or facilitate:
- anything illegal where you or the recipient is located;
- controlled substances, cannabis or THC products (including hemp-derived intoxicants), drug paraphernalia, or unapproved drugs or supplements making disease claims;
- firearms, ammunition, firearm parts, explosives, or weapons;
- tobacco and vaping products;
- adult or sexual content or services; escort services;
- gambling, sweepstakes, or lotteries, unless licensed and approved by us;
- counterfeit or stolen goods, IP infringement;
- payday, high-cost, or predatory lending; debt collection; debt relief or credit repair; get-rich-quick, MLM, or pyramid schemes;
- human trafficking, exploitation, or anything harming minors;
- hate speech, harassment, threats, or violent extremism.
(The SHAFT categories — sex, hate, alcohol, firearms, tobacco — are also restricted by carriers. Alcohol is gated, see regulated-niches.md.)
4. Discrimination and high-risk decisions
- Agents may not make or materially support decisions about credit, employment, housing, insurance, education, health care, or legal rights without our written approval and the required notices and safeguards (for example FCRA, ECOA, Fair Housing Act, EEOC, and state AI laws such as Colorado's).
- No targeting or steering based on protected characteristics.
5. Data and security
- No uploading data you have no right to use, and no PHI unless you're on a HIPAA-enabled plan with a signed BAA.
- No children's data (under 13) or sensitive data (SSNs, card numbers, biometrics, precise geolocation) beyond what the Agent strictly needs.
- No probing, scraping, overloading, reverse engineering, jailbreaking, or prompt-injecting our systems or Agents.
- No using Agents to build a competing product.
6. Your own responsibility for compliance
You alone are responsible for making sure your use of the Agents complies with all laws, regulations, licensing rules, platform policies, and industry codes that apply to your business, your location, and your recipients' locations. Our templates, defaults, guardrails, and compliance features help, but they are not legal advice and don't guarantee compliance. Talk to your own attorney about your industry. You must keep the records that show compliance (consents, opt-outs, approvals) and produce them on request.
7. Reporting and enforcement
Report abuse to our request form. We investigate, may preserve records, and cooperate with carriers and law enforcement as the law requires. Suspended Customers stay liable for fees and for any carrier fines or penalties caused by their use.
